1. Agreement to Terms

By accessing or using Bagged ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the App.

2. Description of Service

Bagged is a social memory application that allows users to:

• Create profiles for people they've met
• Track social interactions ("bagging")
• Search for profiles created by the community
• Access premium features through subscription

3. User Accounts

Account Creation

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. User Content and Conduct

Content Guidelines

You are responsible for all content you upload, including photos and information. You agree not to upload content that:

• Violates any laws or regulations in the United States or European Union
• Infringes on intellectual property rights
• Contains explicit or inappropriate material
• Harasses, threatens, or harms others
• Contains false or misleading information
• Is defamatory, libelous, or constitutes hate speech
• Contains personal information without consent
• Promotes illegal activities or substances

Photo Content Restrictions

Strictly Prohibited Photo Content: No nude, sexual, explicit, or pornographic images are permitted. Photos containing exposed genitalia, breasts, buttocks, or other intimate body parts will result in immediate account suspension. This includes artistic nudity, partial nudity, or suggestive content.

All uploaded photos must be:

• Appropriate for all audiences
• Non-explicit and non-sexual in nature
• Compliant with US and EU content regulations
• Free from copyright violations
• Not depicting illegal activities

Comment Section Rules

The comment section is subject to strict moderation. Comments must comply with US and EU laws. Prohibited comment content includes:

• Defamation and Libel: False statements that damage someone's reputation
• Harassment: Targeted abuse, threats, or intimidation
• Hate Speech: Content attacking individuals based on race, religion, gender, sexuality, or other protected characteristics
• Privacy Violations: Sharing personal information without consent (doxxing)
• Illegal Content: Promoting illegal activities, substances, or services
• Spam and Fraud: Repetitive, misleading, or fraudulent content
• Sexual Content: Explicit sexual descriptions or solicitations
• Violence: Threats, graphic descriptions of violence, or promotion of self-harm

All comments are subject to review and removal at our discretion. Repeated violations will result in account suspension or permanent ban.

Content Moderation

We reserve the right to review, edit, or remove any content at any time without notice. Content that violates these terms will be removed immediately. We employ both automated systems and human moderators to enforce these policies.

Photo Usage Rights

By uploading photos to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute the photos within the App for the purpose of providing the service. You represent that you have the right to upload and share all photos you submit.

6. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

You acknowledge that the App allows users to create profiles of other individuals. You are responsible for ensuring you have the right to share any information you upload.

7. Subscription and Payments

Bagged Pro Subscription

Some features require a paid subscription ("Bagged Pro"). By purchasing a subscription:

• You authorize us to charge your payment method monthly
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your app store account
• No refunds for partial months

Price Changes

We reserve the right to change subscription prices with 30 days notice. Existing subscriptions will maintain their current price until renewal.

8. Prohibited Uses

You agree not to:

1. Use the App for any illegal purpose
2. Impersonate another person or entity
3. Stalk, harass, or harm other users
4. Scrape or collect data from the App
5. Interfere with the App's operation
6. Attempt to gain unauthorized access
7. Use the App for commercial purposes without permission

9. Intellectual Property

The App and its original content (excluding user content), features, and functionality are owned by Bagged and are protected by international copyright, trademark, and other intellectual property laws.

10. Disclaimers and Limitations

Service Availability

We do not guarantee that the App will be available at all times. We may experience hardware, software, or other problems requiring maintenance.

Content Accuracy

We do not verify or endorse user-generated content. Information about individuals in the App may be inaccurate or outdated.

Limitation of Liability

To the maximum extent permitted by law, Bagged shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Bagged and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law
